Dejar el modelo médico, basado en el déficit, por un modelo social que pone el énfasis no en el individuo sino en la sociedad y en la equidad de oportunidades, ha llevado en el mundo entero a que las leyes referidas a las personas con discapacidad dejen de ser meramente proteccionistas, para ser instrumentos que aseguren la igualdad y equidad de oportunidades, así como el respeto de derechos civiles y de libertades fundamentales. El presente estudio indaga en las leyes marco sobre discapacidad de 18 países, catorce de los cuales son de la América hispana, uno de habla portuguesa, dos de Europa y dos de Asia. La matriz de comparación con el caso peruano elaborada por Javier Mujica incluye temas como certificación y registro, educación, salud, promoción laboral, no discriminación, seguridad social, equiparación de oportunidades, accesibilidad y rectoría. |
